Welcome to our online store. These Terms and Conditions (“Terms”, “Agreement”) govern your access to and use of the Website and the purchase of standard and personalised clothing (“Products”) operated by Manta Rebels – Agnieszka Pilat (“we”, “us”, “our”, “Company”), based in Tenerife, Spain.
By browsing the Website, creating an account, or placing an order, you (“you”, “your” or “Customer”) agree to be bound by these Terms.
1. BUSINESS IDENTIFICATION AND LEGAL COMPLIANCE

2. DEFINITIONS
Standard Products
Pre-designed, non-personalised clothing items available for purchase without user-specified modifications.
Personalised Products
Goods made to the consumer’s specifications or clearly personalised (e.g. custom text, uploaded graphics, or specific design choices).
Delivery Location
A third-party location designated by you when placing the order, limited to recognised hotels, resorts, diving centres or other locations approved by the Company in Tenerife, Spain.
3. CONCLUSION OF THE CONTRACT
The presentation of Products on the Website constitutes an invitation to treat.
By clicking the “Pay” or “Complete Order” button, you submit a binding offer to purchase the selected Products.
The sales contract is concluded only when we expressly accept your order by sending an order confirmation email after successful payment, or when we begin the physical production process, whichever occurs first.
We reserve the right to refuse or cancel any order if fraud, unauthorised or illegal activity is suspected.
4. PRICES AND TAXATION IN THE CANARY ISLANDS (IGIC)
Due to our geographical location, our tax obligations fall outside the harmonised EU VAT area.
- Transactions within our jurisdiction are subject to the Canary Islands General Indirect Tax (IGIC).
- All prices are displayed in euros (€) and include the applicable IGIC rate (typically 7%).
• Prices do not include mainland Spanish VAT (IVA).
- The total order cost is displayed before purchase completion.
5. PAYMENT (STRIPE)
All payments are securely processed by Stripe. We do not store full credit card details.
By providing a payment method, you confirm that you are legally authorised to use it. If your payment provider refuses authorisation, we are not responsible for non-delivery.
When paying via online banking, you are responsible for verifying your bank’s website security certificate.
6. DELIVERY POLICY AND TRANSFER OF RISK
(Dive centres, hotels and other approved locations)
Deliveries to designated third-party locations in Tenerife are carried out in person within 48 hours
after order acceptance.
This delivery method is chosen voluntarily by the Customer.
Authorised recipient
By selecting a hotel, dive centre or approved location, you appoint the staff of that establishment as your authorised representatives to receive the parcel.
Transfer of risk
Under Spanish law, risk transfers to you when goods are handed to you or your designated third party.
Release of liability
Once the parcel is handed to the establishment staff, the risk of loss, theft or damage transfers to the Customer.
We are not responsible for events beyond our control, including loss, theft or improper storage by the establishment. Claims should be directed to the establishment.
This does not limit mandatory liability under applicable law.
7. PERSONALISED PRODUCTS – CUSTOMER CONTENT
Intellectual property warranty
You warrant that submitted content does not infringe third-party rights and agree to indemnify us against any claims arising from its use.
Proof approval
You are responsible for final approval of layout, spelling and grammar. We are not liable for errors approved or submitted by you.
8. COLOUR VARIATION DISCLAIMER
Screen colours differ from printed colours due to RGB vs CMYK processes. This natural difference does not constitute a defect or non-conformity.
To the maximum extent permitted by law, claims based solely on colour differences will not be accepted.
9. RETURNS, COMPLAINTS AND LEGAL GUARANTEE
Your rights are governed by the Spanish Consumer Law (TRLGDCU).
9.1 Personalised Products
The right of withdrawal does not apply to personalised goods (Art. 103(c)). All personalised sales are final except in case of defects or Company error.
9.2 Standard Products – Right of Withdrawal
You may withdraw within 14 days of receiving non-personalised products. Returned items must be unused and in original condition.
Customers bear return shipping costs.
Refunds are issued within 14 days after receiving the returned product.
9.3 Legal Guarantee (Defects)
A 3-year legal guarantee of conformity applies.
If a defect or Company error occurs, we will repair, replace or refund the product and cover return shipping.
Complaints must include photo evidence and are reviewed within 14 working days. Minor size differences (1–3 cm) are not defects.
9.4 Good-faith resolution
We aim to resolve issues amicably wherever possible.
10. INTELLECTUAL PROPERTY AND LIMITATION OF LIABILITY
We own all intellectual property rights to Website materials not submitted by users.
To the maximum extent permitted by law, we exclude liability for indirect or consequential damages arising from Website use.
Nothing in these Terms excludes liability for death, personal injury, fraud or gross negligence where such liability cannot be excluded by law.
We are not liable for delays or failures caused by events beyond our reasonable control, including natural disasters, strikes, pandemics or supply chain disruptions.
11. GOVERNING LAW AND
JURISDICTION
These Terms are governed by Spanish law, including applicable Canary Islands regulations.
Disputes fall under the jurisdiction of the courts of Santa Cruz de Tenerife, without prejudice to mandatory consumer rights allowing claims in the consumer’s country of residence.
